第一條 為保障民用航空安全,維護(hù)公眾利益,促進(jìn)民用航空事業(yè)的發(fā)展,特制定本條例。
第二條 在中華人民共和國境內(nèi)從事民用航空器(含航空發(fā)動(dòng)機(jī)和螺旋槳,下同)的設(shè)計(jì)、生產(chǎn)、使用和維修的單位或者個(gè)人,向中華人民共和國出口民用航空器的單位或者個(gè)人,以及在中華人民共和國境外維修在中華人民共和國注冊(cè)登記的民用航空器的單位或者個(gè)人,均須遵守本條例。
第三條 民用航空器的適航管理,是根據(jù)國家的有關(guān)規(guī)定,對(duì)民用航空器的設(shè)計(jì)、生產(chǎn)、使用和維修,實(shí)施以確保飛行安全為目的的技術(shù)鑒定和監(jiān)督。
第四條 民用航空器的適航管理由中國民用航空局(以下簡(jiǎn)稱民航局)負(fù)責(zé)。
第五條 民用航空器的適航管理,必須執(zhí)行規(guī)定的適航標(biāo)準(zhǔn)和程序。
第六條 任何單位或者個(gè)人設(shè)計(jì)民用航空器,應(yīng)當(dāng)持航空工業(yè)部對(duì)該設(shè)計(jì)項(xiàng)目的審核批準(zhǔn)文件,向民航局申請(qǐng)型號(hào)合格證。民航局接受型號(hào)合格證申請(qǐng)后,應(yīng)當(dāng)按照規(guī)定進(jìn)行型號(hào)合格審定;審定合格的,頒發(fā)型號(hào)合格證。
第七條 任何單位或者個(gè)人生產(chǎn)民用航空器,應(yīng)當(dāng)具有必要的生產(chǎn)能力,并應(yīng)當(dāng)持本條例第六條規(guī)定的型號(hào)合格證,經(jīng)航空工業(yè)部同意后,向民航局申請(qǐng)生產(chǎn)許可證。民航局接受生產(chǎn)許可證申請(qǐng)后,應(yīng)當(dāng)按照規(guī)定進(jìn)行生產(chǎn)許可審定;審定合格的,頒發(fā)生產(chǎn)許可證,并按照規(guī)定頒發(fā)適航證。
任何單位或者個(gè)人未按照前款規(guī)定取得生產(chǎn)許可證的,均不得生產(chǎn)民用航空器。但本條例第八條規(guī)定的除外。
第八條 任何單位或者個(gè)人未取得生產(chǎn)許可證,但因特殊需要,申請(qǐng)生產(chǎn)民用航空器的,須經(jīng)民航局批準(zhǔn)。
按照前款規(guī)定生產(chǎn)的民用航空器,須經(jīng)民航局逐一審查合格后,頒發(fā)適航證。
第九條 民用航空器必須具有民航局頒發(fā)的適航證,方可飛行。
民航局頒發(fā)的適航證應(yīng)當(dāng)規(guī)定該民用航空器所適用的活動(dòng)類別、證書的有效期限及安全所需的其他條件和限制。
第十條 持有民用航空器生產(chǎn)許可證的單位生產(chǎn)的民用航空器,經(jīng)國務(wù)院有關(guān)主管部門批準(zhǔn)需要出口時(shí),由民航局簽發(fā)出口適航證。
第十一條 在中華人民共和國境內(nèi)飛行的民用航空器必須具有國籍登記證。在中華人民共和國注冊(cè)登記的民用航空器,具有中華人民共和國國籍,國籍登記證由民航局頒發(fā)。民用航空器取得國籍登記證后,必須按照規(guī)定在該民用航空器的外表標(biāo)明國籍登記識(shí)別標(biāo)志。
第十二條 中華人民共和國的任何單位或者個(gè)人進(jìn)口外國生產(chǎn)的任何型號(hào)的民用航空器,如系首次進(jìn)口并用于民用航空活動(dòng)時(shí),出口民用航空器的單位或者個(gè)人必須向民航局申請(qǐng)型號(hào)審查。民航局接受申請(qǐng)后,應(yīng)當(dāng)按照規(guī)定對(duì)該型號(hào)民用航空器進(jìn)行型號(hào)審查;審查合格的,頒發(fā)準(zhǔn)予進(jìn)口的型號(hào)認(rèn)可證書。
第十三條 中華人民共和國的任何單位或者個(gè)人租用的外國民用航空器,必須經(jīng)民航局對(duì)其原登記國頒發(fā)的適航證審查認(rèn)可或者另行頒發(fā)適航證后,方可飛行。
第十四條 任何單位或者個(gè)人的民用航空器取得適航證以后,必須按照民航局的有關(guān)規(guī)定和適航指令,使用和維修民用航空器,保證其始終處于持續(xù)適航狀態(tài)。
第十五條 加裝或者改裝已取得適航證的民用航空器,必須經(jīng)民航局批準(zhǔn),涉及的重要部件、附件必須經(jīng)民航局審定。
第十六條 中華人民共和國境內(nèi)和境外任何維修單位或者個(gè)人,承擔(dān)在中華人民共和國注冊(cè)登記的民用航空器的維修業(yè)務(wù)的,必須向民航局申請(qǐng)維修許可證,經(jīng)民航局對(duì)其維修設(shè)施、技術(shù)人員、質(zhì)量管理系統(tǒng)審查合格,并頒發(fā)維修許可證后,方可從事批準(zhǔn)范圍內(nèi)的維修業(yè)務(wù)活動(dòng)。
第十七條 負(fù)責(zé)維修并放行在中華人民共和國注冊(cè)登記的民用航空器的維修技術(shù)人員,必須向民航局提出申請(qǐng),經(jīng)民航局或者其授權(quán)單位考核合格并取得維修人員執(zhí)照或者相應(yīng)的證明文件后,方可從事民用航空器的維修并放行工作。
第十八條 民用航空器的適航審查應(yīng)當(dāng)收取費(fèi)用。收費(fèi)辦法由民航局會(huì)同財(cái)政部制定。
第十九條 民航局有權(quán)對(duì)生產(chǎn)、使用、維修民用航空器的單位或者個(gè)人以及取得適航證的民用航空器進(jìn)行定期檢查或者抽查;經(jīng)檢查與抽查不合格的,民航局除按照本條例的有關(guān)規(guī)定對(duì)其處罰外,還可吊銷其有關(guān)證件。
第二十條 使用民用航空器進(jìn)行飛行活動(dòng)的任何單位或者個(gè)人有下列情形之一的,民航局有權(quán)責(zé)令其停止飛行,并視情節(jié)輕重,處以罰款:
一、民用航空器未取得適航證的;
二、民用航空器適航證已經(jīng)失效的;
三、使用民用航空器超越適航證規(guī)定范圍的。
第二十一條 維修民用航空器的單位或者個(gè)人,有下列情形之一的,民航局有權(quán)責(zé)令其停止維修業(yè)務(wù)或者吊銷其維修許可證,并視情節(jié)輕重,處以罰款:
一、未取得維修許可證,擅自承接維修業(yè)務(wù)的;
二、超過維修許可證規(guī)定的業(yè)務(wù)范圍,承接維修業(yè)務(wù)的;
三、由未取得維修人員執(zhí)照的人員負(fù)責(zé)民用航空器的維修并放行的。
第二十二條 任何單位或者個(gè)人違反本條例第七條規(guī)定,擅自生產(chǎn)民用航空器的,民航局有權(quán)責(zé)令其停止生產(chǎn),并視情節(jié)輕重,處以罰款。
第二十三條 按照本條例受到處罰的單位的上級(jí)主管機(jī)關(guān),應(yīng)當(dāng)根據(jù)民航局的建議對(duì)受罰單位的主要負(fù)責(zé)人或者直接責(zé)任人員給予行政處分;情節(jié)嚴(yán)重,構(gòu)成犯罪的,由司法機(jī)關(guān)依法追究刑事責(zé)任。
第二十四條 民航局因適航管理工作的過失造成人身傷亡或者重大財(cái)產(chǎn)損失的,應(yīng)當(dāng)承擔(dān)賠償責(zé)任,并對(duì)直接責(zé)任人員給予行政處分;直接責(zé)任人員的行為構(gòu)成犯罪的,由司法機(jī)關(guān)依追究刑事責(zé)任。
第二十五條 民航局從事適航管理的工作人員,利用職務(wù)之便營(yíng)私舞弊的,應(yīng)當(dāng)給予行政處分;情節(jié)嚴(yán)重,構(gòu)成犯罪的,由司法機(jī)關(guān)依法追究刑事責(zé)任。
第二十六條 任何單位或者個(gè)人對(duì)民航局作出的罰款決定不服的,可以在接到罰款通知書之日起十五日內(nèi)向民航局提請(qǐng)復(fù)議,也可以直接向人民法院起訴;期滿不提請(qǐng)復(fù)議也不起訴又不執(zhí)行的,民航局可以申請(qǐng)人民法院強(qiáng)制執(zhí)行。
第二十七條 民航局應(yīng)當(dāng)在廣泛征求航空工業(yè)部及各有關(guān)部門意見的基礎(chǔ)上,制定本條例的實(shí)施細(xì)則及有關(guān)技術(shù)標(biāo)準(zhǔn)。
第二十八條 本條例由民航局負(fù)責(zé)解釋。
第二十九條 本條例自一九八七年六月一日起施行。?

REGULATIONS OF THE PEOPLE'S REPUBLIC OF CHINA FOR THE ADMINISTRA-TION OF THE AIRWORTHINESS OF CIVIL AIRCRAFT(Promulgated by the State Council on May 4, 1987)Article 1These Regulations are formulated for the purpose of ensuring safety incivil aviation, protecting public interests and promoting the developmentof civil aviation undertakings.Article 2All units or individuals that are engaged in the designing, manufacturing,use and maintenance of civil aircraft (including aircraft engines andpropellers, and the same hereinafter) within the People's Republic ofChina, all units or individuals that export civil aircraft to the People'sRepublic of China, and all units or individuals that perform outside thePeople's Republic of China maintenance services to aircraft registered inthe People's Republic of China shall abide by these Regulations.Article 3The administration of the airworthiness of civil aircraft denotes thetechnical appraisal and supervision exercised in accordance with thepertinent provisions of the State over the designing, manufacturing, useand maintenance of civil aircraft for the purpose of ensuring safety inflight.Article 4The Civil Aviation Administration of China (hereinafter referred to as the"CAAC") shall be responsible for the administration of the airworthinessof civil aircraft.Article 5The administration of the airworthiness of civil aircraft shall beexercised in accordance with the prescribed airworthiness criteria andprocedures.Article 6Any units or individuals that intend to design civil aircraft shall, onthe strength of the document issued by the Ministry of Aeronautic Industryfor the examination and approval of the design project, apply to the CAACfor a Certificate of Up-to-Standard Model. The CAAC shall, after receiptof the application therefor, conduct the examination and appraisal, inaccordance with the relevant provisions, as to whether the model to bedesigned is up to standard and, if the model is proved to be up tostandard, a Certificate of Up-to-Standard Model shall be issued.
Article 7Any units or individuals that intend to manufacture civil aircraft shallhave the necessary manufacturing capacity and shall, on the strength ofthe Certificate of Up-to-Standard Model as prescribed in Article 6 ofthese Regulations and with the consent of the Ministry of AeronauticIndustry, apply to the CAAC for a Manufacturing Permit. The CAAC shall,after receipt of the application therefor, conduct examination andappraisal, in accordance with the relevant provisions, as to whether theapplicants are qualified to obtain a Manufacturing Permit, if they areproved to be qualified, a Manufacturing Permit shall be issued to them,together with an Airworthiness Certificate to be issued in accordance withthe relevant provisions.No units or individuals that have not obtained a Manufacturing Permit inaccordance with the provisions of the preceding paragraph may manufacturecivil aircraft, except as otherwise prescribed in the provisions ofArticle 8 of these Regulations.Article 8Any units or individuals that have not obtained a Manufacturing Permit butintend to manufacture civil aircraft as a result of special needs shallapply to the CAAC for approval. Civil aircraft manufactured in accordancewith the provision in the preceding paragraph shall be examined one by oneand only after each of them is proved to be up to standard shall anAirworthiness Certificate be issued.
Article 9Civil aircraft may engage in flight operations only when they havepossessed an Airworthiness Certificate issued by the CAAC.The Airworthiness Certificate issued by the CAAC shall specify the type(s)of activities the aircraft is (are) good for, the period of validity ofthe Certificate, and other conditions and restrictions required forensuring safety.Article 10If civil aircraft manufactured by units possessing a Civil AircraftManufacturing Permit are to be exported as approved by the competentauthorities under the State Council, the Airworthiness Certificate forExport shall be issued by the CAAC.Article 11Civil aircraft that are to fly within the People's Republic of China mustpossess Nationality Registration Certificates. Civil aircraft that havebeen registered in the People's Republic of China shall bear thenationality of the People's Republic of China and shall be issuedNationality Registration Certificate by the CAAC.
